Nexi Update ("APP") is a mobile application owned by SIA S.p.A., with legal and administrative headquarter at via F. Gonin 36, Milano, tax codexxxxxxxx, vat number and subscription number in Milan Companies Register 10536540152. SIA S.p.A. distributes the APP to its customers to permit to the customers authorized employees (Users) to receive news and technical bulletinsprovided by SIA using the Nexi Update service.
To download the APP, the User must first accept the Terms and Conditions that are published on the relevant mobile store (App Store, Google Play Store). The Access to the APP - after registration of the User - is performed by entering an email and password at the link made available by the contact person - previously commissioned by SIA - of the Customer company.
SIA S.p.A. will use the utmost care to avoid interruptions in the availability of the App and ensure its regular operation. The User acknowledges that SIA SpA may suspend, interrupt, modify, remove or make changes to the App with immediate effect and without obligation to notify the User, for management, maintenance and / or update needs of the App and without responsibility for any type, subject to the limits established by law, for any damage suffered by the User.
The User is the only party responsible for the access to the APP. The User recognizes and agrees that the APP and any other services related to it can involve the use of proprietary and confidential information protected by the laws applicable with regard to intellectual property and other regulations or international agreements. SIA S.p.A does not ask any charge for the use of the APP. All the costs and expenses of the internet connection in order for the use of the APP are fully charge to the User. SIA S.p.A. grants to the User a right of use, not transferable and not exclusive, of the APP as "seen and approved". The User undertakes not to perform, directly or indirectly, any of the following activities: copy (amend), create versions deriving from the source code, decode, disassembly or try to discover said code, sell, transfer, grant in sublicense or otherwise transfer any other right related to the APP.
SIA S.p.A. is not liable for damages that may arise from the App, except in cases of wilful misconduct and gross negligence, pursuant to Article 1229 of the Civil Code.
The user acknowledges that any communication regarding the App must be sent to the Contact Person appointed by SIA, according to the procedures agreed with the same.
Italian law regulates these Terms and Conditions and the relations between SIA S.p.A. and the User. Any dispute arising out of or related to these conditions or to the use of the APP will be remitted to the Court deined by D.Lgs. 205/2006 (Codice del Consumo).
SIA S.p.A. reserves the right to make changes to the App at any time, to adapt it to legislative changes. The User can always find the most recent version of the Terms and Conditions within the App in the "Privacy Policy and Terms and Conditions" section.

This Privacy Notice refers to the processing of your Personal Data by Nexi Update Mobile Application (hereafter referred to as "APP"), powered by SIA S.p.A.
SIA, as Controller (hereafter referred to as "Controller"), inform you as follows.
We collect Personal Data (e.g., name, surname, email) that you provided at the time of download and registration to the APP, and later, using the APP for the following purposes: (i) managing your registration to the APP, (ii) supplying APP functions and connected services (e.g., customer service).
Furthermore, our online activities include the management of your APP interaction, answering your questions and requests and the availability, if requested, of information/materials. Supplying Personal Data for the above-mentioned purposes allow us to perform our contractual obligation, to answer your questions and to fulfil our legal obligations. Any refusal to provide Personal Data may not allow as to provide the APP functions, including information and materials you request. Personal Data can be used to update and/or amend information about you, previously collected.
The processing of Personal Data is based on the following legal basis: (i) execution of contractual obligations or pre-contractual measures adopted upon request (e.g., when you demand a service/product or have a question), (ii) fulfilment of legal obligations, (iii) legitimate interest for administrative internal purposes, fraud or other illegal activities prevention.
Personal Data processing is carried out by informatics and telematics technologies in accordance with procedures strictly connected to the processing purposes specified in this Privacy Notice, in line with the state of the art standards and technologies. Personal Data are retained only as long as strictly necessary to fulfil the purposes Personal Data were collected for and, in any case, not beyond the maximum term required by the applicable law.
Personal Data may be shared with third parties involved in corporate and extraordinary operations, as legitimate recipients. Moreover, Personal Data may be shared with consultants, professional and technical service providers, who may act, as Controller or Processor. Personal Data are provided to the third parties above only when strictly necessary for the fulfilment of the above - mentioned purposes of the processing.
Personal Data shall not be transferred outside the European Economic Area.
You can always exercise your privacy rights (pursuant to articles 15 - 22 of the GDPR), for example you can access your Personal Data, check the contents, updating and rectification, object to the processing of your Personal Data according to legitimate reasons - e. g. in case of marketing activity -, or demand the processing limitation. Furthermore, you can always lodge a complaint with the Data Protection Supervisory Authority.
